Mr. Garner has been counseling clients in the online space since the early 2000’s and has seen the evolution of the e-commerce market first-hand. His clients’ industries are varied, from healthcare to ad networks. Mr. Garner's clients benefit from his understanding of the day-to-day business operations that are unique to online companies, which enables him to provide them with advice on resolving a variety of business problems.
Mr. Garner combines his background in transactional intellectual property matters with his M.B.A. to serve as general counsel to his clients. He has the online industry experience necessary to guide them through the challenges that e-commerce companies regularly face, including providing counsel in the online advertising arena.
As issues related to online advertising continue to develop, Mr. Garner stays abreast of how new laws and regulations will affect his clients and what they can do to continue to grow their businesses in the dynamic online space. Mr. Garner regularly advises advertising networks, advertisers, and publishers concerning asset and technology protection, privacy issues, protection of client and pricing information, and other compliance and best practices matters. He counsels his clients on advertising, promotions, sweepstakes, trade regulations, entertainment and other federal and state regulatory matters regarding both online and offline initiatives. He also works closely with clients to draft, revise and update marketing/advertising agreements, ad network agreements, publisher agreements and co-branding agreements, and represents clients in negotiations concerning those agreements.
Representative Work
- Develop, protect and monetize intellectual property assets for both small and large institutional clients and manage their trademark portfolio.
- Represent clients in high-stakes litigation, for both commercial and intellectual property, in federal courts and before the U.S. Patent and Trademark Office. Intellectual property litigation experience extends from patent, copyright and trademark infringement to cases involving trade secrets, counterfeiting, advertising, e-commerce and more.
- Negotiate a broad range of agreements relating to trademarks, copyrights, software, licenses, alliances and transfers, and a host of others involving electronic commerce and the development, commercialization and exploitation of intellectual property rights and assets.
- Handle transactions involving emerging multimedia issues, including Internet strategy development and implementation, and the creation of affiliation and strategic alliance agreements and cross-promotion arrangements.
