Consumer Financial Protection Bureau Investigations and FTC Coordination Tips and Techniques

The Consumer Financial Protection Bureau (CFPB) has begun work in earnest with regard to nonbank investigations. In addition the Bureau has announced a set of proposed procedural rules. For practitioners defending actions at the CFPB, the new sheriff also has new and sometimes different ways of dealing with investigations, including negotiating the scope of the Civil Investigative Demand, expectations for compliance with the CID, and handling settlement discussions. This panel will include enforcers and practitioners with active cases at the new agency to talk about best practices, the proposed procedural rules and share their early experiences. And after all of the talk about how the CFPB and the Federal Trade Commission plan to coordinate their enforcement efforts, such coordination is now underway, and the panel will also include an enforcer from the FTC to discuss how those efforts are unfolding.
