David D. Conway
David Conway is an associate in Venable's Intellectual Property Litigation Practice Group. Mr. Conway's practice involves assisting clients on a variety of issues, focusing especially on trademark, unfair competition, federal and state advertising laws, and right of publicity.
While earning his law degree, Mr. Conway served as judicial intern to the Honorable Diane S. Sykes, Seventh Circuit Court of Appeals, and the Honorable Charles N. Clevert, United States District Court, Eastern District of Wisconsin.
Representative Experience
Mr. Conway’s experience includes participating in the following matters:
- Drafted and edited an amicus brief filed in the United States Supreme Court on behalf of former U.S. Senator Birch Bayh, which was submitted in support of the Bayh-Dole Act, the statute that forms the basis for the modern university technology transfer system.
- Secured a dismissal of claims on jurisdictional grounds against a trade association that sought cancellation of the client’s trademark.
- Represented an international media and marketing company in its effort to prevent the misuse of its trademarks on the Internet through a preliminary injunction that prohibited a competitor from using the client’s trademarks as search engine keywords to draw consumers to websites containing false statements about the client’s products.
- Successful defense of a dietary supplement manufacturer against an FTC civil contempt motion.
- Researched and drafted a successful motion to dismiss all false advertising claims against a major U.S. food manufacturer in a consumer class action lawsuit.
- Researched and submitted a petition for writ of certiorari to the United States Supreme Court on behalf of an inventor and patent owner seeking to overturn a federal preemption ruling by the Federal Circuit.
Activities
Mr. Conway is a Young Lawyer Representative for the American Bar Association’s Section of Antitrust Law, Private Advertising Litigation Committee. He is also a weekly contributor to
Private Advertising Litigation Updates, an ABA newsletter that reports on advertising, marketing, and consumer litigation case law developments.
On a
pro bono basis, Mr. Conway has successfully represented clients before the Social Security Administration’s Office of Disability Adjudication and Review.
