Ms. McClain concentrates her practice in negotiating health benefit agreements between the firm's major private government contractors and the nation's largest healthcare companies. As a lead team negotiator, Ms. McClain works with healthcare companies to pursue agreements specifying contractual terms necessary to the firm's private government contractor clients regarding the administration of employee benefits, the resolution of business disputes, and the privacy and protection of confidential company and employee information. Ms. McClain also advises companies that provide goods and services to the federal government regarding compliance with the Office of Federal Contract Compliance Programs (OFCCP) diversity requirements.
As an employment attorney, Ms. McClain has successfully represented management in the defense of age, race, gender and disability-related cases in the state and federal courts and administrative charges before the EEOC and local agencies. Most recently, she served as second-chair in a federal jury trial and successfully defended a national university against allegations of sexual harassment, retaliation and breach of contract by a former visiting professor. Ms. McClain continued to successfully defend the case through both the federal court appeal and ultimate petition for certiorari to the United States Supreme Court.
Before joining Venable, Ms. McClain practiced in the Washington, DC office of a large international law firm where she managed complex litigation discovery matters and conducted sensitive internal investigations.
