Marcia A. Auberger
Marcia Auberger is a member of the firm's Trademark, Copyright and Licensing practice group. Her practice focuses primarily on domestic and international trademark prosecution and the maintenance of domestic and international trademark portfolios for a wide range of clients and industries. Her practice involves trademark availability searching, registering, licensing, and enforcing brand names, logos, slogans and trade dress and includes bringing and defending opposition and cancellation actions, namely, administrative litigation, before the U.S. Trademark Trial and Appeal Board. She also counsels clients in the field of copyright law. She has developed a worldwide network of foreign counsel that she relies upon to assist in registering and enforcing her client's intellectual property rights in foreign jurisdictions.
The Trademark, Copyright and Licensing practice group ranks highly in two benchmark annual reports: ninth in U.S. trademark applications filed (Trademark Insider, pub. 2010); and 12th in U.S. trademark registrations issued (Intellectual Property Today, pub. 2010). The group ranks 1st in Washington, DC, the third-busiest trademark market in the country, in both reports.
Prior to joining her current practice group, Ms. Auberger's practice focused on intellectual property litigation matters, including Section 337 investigations before the International Trade Commission.
Activities
In addition to her professional memberships, Ms Auberger has previously served on various committees with both the International Trademark Association and the Intellectual Property Owners Association. She currently advises nonprofit entities on a pro-bono basis with their intellectual property and unfair competition matters and serves as a court-appointed Educational Surrogate Parent, also on a pro-bono basis, for a young girl with special needs. She has also served on the firm's hiring committee. During her legal career, Ms Auberger was also active with the young lawyer organizations at the local, state and national level, previously served as President of the Galveston County Young Lawyers Association and was the recipient of the Outstanding Young Lawyer award.
