Michael Madden focuses on complex commercial litigation, including bankruptcy, financial, insurance, and class action and multidistrict litigation.
During the course of thirty years of practice, Mr. Madden has had extensive experience representing national and international clients on matters in federal and state courts and before federal agencies and arbitration panels involving a wide range of complex contract, financial, and other business disputes.
Significant Matters
Mr. Madden recently was part of a Venable team acting as special litigation counsel to Enron Creditors Recovery Corp. in lawsuits seeking recovery of payments made to large financial institutions prior to Enron’s filing for bankruptcy. He has represented clients in connection with claims relating to the termination of ISDA agreements resulting from bankruptcy filings. His experience with insurance coverage litigation includes the current representation of an industrial company on a claim for business interruption losses, and in the past, Mr. Madden represented an excess insurer in the defense of a complex insurance coverage dispute involving a claim in excess of $150 million by a multinational insured under the errors and omissions coverage of a specialty insurance policy. He also represented, as national defense counsel, the manufacturer of a prescription drug in connection with a nation-wide class action and multi-district litigation proceeding (the class action certification was vacated by the 9th Circuit on interlocutory appeal).
