Patrick L. Clancy
Patrick Clancy concentrates on labor and employment law for both private and public sector clients. He represents employers before state and federal courts and administrative agencies at all levels in employment related litigation, particularly in the area of employment discrimination. Mr. Clancy has also counseled and defended clients in disability accessibility issues under Title III of the Americans with Disabilities Act involving facilities and public accommodations. His practice also focuses on strategies to avoid or minimize litigation, including day-to-day counseling on employment policies, practices, and employment decisions such as termination. He regularly counsels clients on wage payment and wage and hour matters, including classification of employees under the Fair Labor Standards Act. He has worked with public agencies in the collective bargaining process, advised on labor issues and agreement implementation and handled labor arbitrations.
Mr. Clancy is a frequent speaker and lecturer to audiences of public and private employers on various employment topics. He regularly trains management, supervisors, and employees in such areas as sexual harassment, the Americans with Disabilities Act, the Family and Medical Leave Act, and sound workplace practices.
Significant Matters
Mr. Clancy has handled disability discrimination actions before the U.S. District Court for the District of MD, a major multi-plaintiff sexual harassment suit, and an extensive EEOC directed age discrimination investigation. He helped lead a team of attorneys and experts in the successful defense of a major OFCCP enforcement proceeding. He has helped clients obtain summary judgments in American with Disabilities Act and Title VII cases before federal courts. He has recently defended an executive against fraud and tort claims brought by a former employee.
Activities
Active in professional associations, Mr. Clancy belongs to the Montgomery County Bar Association, the American Bar Association, the Maryland State Bar Association, and the District of Columbia Bar Association, and the related labor and employment law sections. He serves on the Maryland Court of Appeals Character Committee. He is a former chair of the Montgomery County Bar Association Labor and Employment Section, a former editor of the Maryland Employment Law Letter, and former executive editor of Venable’s Workplace Labor Update. He also served on the Board of Directors of Our Lady of Good Counsel High School.
