Robert S. Babayi
Partner

Robert Babayi's practice focuses on client counseling, patent prosecution, licensing and litigation. Mr. Babayi was in-house counsel at Motorola Inc. and IBM Corp., and understands patents at a very practical level. He is familiar with licensing and world-wide patent portfolio strategy.

Mr. Babayi has prepared and prosecuted several hundred U.S. and foreign patents with primary emphasis on wired and wireless telecommunications, computing architecture, network-layer protocols, semiconductors, manufacturing processes, power systems, object-oriented programming, and the Internet- and e-commerce- related inventions.

Mr. Babayi is very familiar with PCT practice, reexamination, and re-issue and national phase proceedings.

Mr. Babayi counsels clients on validity, enforceability and infringement of patents. He provides strategic advice on relevance, strength and value of patents to commercial markets. Mr. Babayi analyzes the risks associated with enforcing or defending patent portfolios, negotiates licensing terms and manages patent licensing programs.

Mr. Babayi has been involved in defensive and offensive aspects of complex patent litigations before the ITC and in the District Court level. He has taken and defended depositions, selected experts, and prepared fact and expert witnesses for testimony.

  • Acts as outside general  counsel to small companies, advising them on transactional and dispute resolution while managing their litigation
  • Manages a large patent portfolio for a government contractor covering emerging wireless technologies with commercial and military applications
  • Manages small and large patent portfolios for numerous emerging technology and publicly-traded companies that develop network security, real-time high-definition IP content delivery, programmable magnetic structures, nano-gaps, and ultrawideband real-time positioning and radars as well as various acquired patent portfolios 
  • Counsels startup companies in obtaining valuable patents for developed technologies
  • Assisted patentee with  licensing optical filter technology used in windows and display devices by identifying potential licensees and negotiating amicable licensing terms
  • Represents the research arm of a multinational power supply company before the United States and foreign patent offices
  • Manages a patent portfolio covering various online educational systems and advises the client on the patent's relevance to the evolving virtual education market
  • Negotiated with intelligence-related venture-based company for an equity stake in an emerging technology client
  • Representative cases include:
    • Agere Systems Guardian Corp. v. Proxim, Inc., No. 01 339 RRM (D. Del. 2001), represented plaintiff in infringement action concerning patents related to wireless technology under IEEE 802.11 standard.
    • In re Certain Wireless Local Area Network Cards, ITC Investigation 337-TA-455, represented one of the intervenors in an action involving wireless local area network (LAN).
