Thomasina Poitrot
Thomasina Poirot is a litigator who focuses on complex pharmaceutical litigation and insurance coverage matters. Thomasina represents pharmaceutical and laboratory companies, and has been a member of trial teams where she works with clients to prepare for fact witness and employee examinations, drafts dispositive motions and motions in limine, and assists with opening and closing statements and demonstratives. She works with expert witnesses in areas such as neurology, neurosurgery, epidemiology, genetics, pain, phlebotomy standard of care, and pharmaceutical product labeling. Thomasina also takes and defends expert and fact witness depositions, and assists in the evaluation and implementation of mass tort settlements.

In addition to her work with pharmaceutical and laboratory clients, Thomasina advises for-profit companies and nonprofit organizations regarding the adequacy of their insurance portfolios, in light of their specific operations, and industry and legal risks. She works with clients and brokers to implement strategies and recommend insurance products to fit each client’s needs and reduce their financial exposure.

Prior to and during law school, Thomasina worked as a senior account executive for a large insurance company. In this capacity, she performed complex coverage and liability analyses, and litigation management for asbestos, lead, hazardous waste, and pharmaceutical matters. She worked with attorneys, agents, risk managers, and in-house counsel to evaluate the risks of litigation and settlements in toxic tort claims.

Representative Matters

  • Plays a significant role in the representation of a leading national laboratory in a variety of litigation matters, including genetic testing and phlebotomy personal injury claims. Manages all phases of the litigation, including responding to initial pleadings and discovery requests, taking and defending depositions, drafting of dispositive motions and motions in limine, and organizing overall litigation strategy and eventual trial strategy and execution, or settlement, if necessary
  • Served as a member of a team representing the manufacturer of an antiepileptic drug in nationwide litigation involving allegations of birth defect injuries. Worked with attorneys from around the country to coordinate overall strategy and the day-to-day handling of individual cases filed throughout numerous federal and state courts.  As part of the on-site trial team, assisted with five separate month-long trials nationwide
  • Served as a member of a trial team that successfully obtained a defense verdict in a personal injury case in which the plaintiff alleged that the phlebotomist breached the standard of care during a routine blood draw

Pro Bono

  • Over a two-year period, devoted more than 400 pro bono hours and was instrumental in resolving a lawsuit on behalf of eight Baltimore community associations against the owner of a vacant property, operating nuisances within their boundaries
