How much do you know about the ADR procedures available at the various government contracts venues? Did you know that, over the last 20 years, the Armed Services Board of Contract Appeals has a success rate of approximately 95% in nonbinding ADR proceedings? With the cost of litigation increasing every year, it is no wonder that parties (and judges) are looking more to ADR for resolving seemingly unsolvable disputes. In fact, the FAR directs agencies to employ reasonable efforts to resolve controversies before the submission of a claim.
