Venable represented HESCO Bastion Ltd in protesting the Army’s award of a contract for earth-filled barrier to a competitor

On April 3, 2018, The Government Accountability Office (GAO) issued a decision granting reimbursement of protest costs for Venable's client, HESCO Bastion Ltd., when the firm protested the Army's award of a contract for earth-filled barrier to a HESCO competitor. In the decision, the GAO found that the HESCO protest was clearly "meritorious" and the Army unduly delayed taking corrective action in response to this protest. Ultimately, the Army withdrew the initial award and allowed HESCO to re-compete for the award of the contract. As a result of the Army's failure to timely respond and to take corrective action in response to the protest, the GAO ordered that the Army must reimburse HESCO’s protest costs as required by government regulation.
