In an October 28, 2014 article, Legal Times featured Venable's role in the reversal of a murder conviction by the D.C. Court of Appeals. Last week, the Court reversed the convictions of Gary Gathers and Keith Mitchell, who have been in prison for more than 20 years. Gathers and Mitchell were convicted of first degree murder in 1993 and sentenced to 35 years to life in prison. The Court found that the government violated the Constitution by introducing and exploiting false testimony from a Metropolitan Police Department detective.
"This decision has been 20 years in the making" said Venable partner Seth Rosenthal, who represents Gathers and argued the appeal on behalf of both men. "Gary is gratified but remains determined to achieve full vindication. He's maintained his innocence all along."
In addition to Rosenthal, Gathers is also represented by Matthew Beville of WilmerHale LLP, and Thomas Degonia of Ethridge Quinn Kemp McAuliffe Rowan & Hartinger. Mitchell is represented by Amit P. Mehta of Zuckerman Spaeder LLP. The team partnered with the Mid-Atlantic Innocence Project on the case.
