Venable partner David L. Strickland was quoted in a March 7, 2015 Automotive News article on the recall authority of the National Highway Traffic Safety Administration (NHTSA). The agency is considering invoking a little-known authority ordering automakers and suppliers involved in a recall to increase the availability of replacement parts while also forcing other suppliers to step in as well.
According to Strickland, a former NHTSA administrator, such a move would be unprecedented and was never needed during his tenure. "As far as I know, they'll have the ability to execute more and more aggressive fines," Strickland said noting that a company can be fined for refusing to comply with NHTSA. "I don't think that there's anything more the agency can do."
