Venable partner David Strickland was quoted in an August 5, 2016 Law360 article on regulatory issues surrounding driverless cars. As the technology improves and becomes more common, accident liability will shift from away from drivers and more towards manufacturers. Until a clearer regulatory framework is in place, most insurers have opted to stay on the sidelines and currently do not offer coverage for the driverless cars.
"The regulatory framework issues are going to be very important in how fast the industry gets this technology deployed," said Strickland. "With these autonomous vehicles, the question is, 'Where does the federal government's responsibility end and that of the states begin, and how do you delineate between the two?'"
