On January 24, 2017, The Recorder
reported on a victory obtained by Venable partner Tom Wallerstein
in a closely watched case involving the Defend Trade Secrets Act. Wallerstein’s clients are two former Brunswick Rail Management executives accused of misappropriating trade secrets that were alleged to have hurt the company’s bargaining position in a $600 million debt restructuring. After intensive expedited briefing, the Court dissolved a temporary restraining order that had been entered ex parte, denied the plaintiffs’ request for a preliminary injunction, and denied the plaintiff’s request for expedited discovery. The article quoted Wallerstein’s briefing in presenting his clients’ view of the evidence.
