A primary contributor to the higher costs of class actions is the size of a market exposed to potential damages from an allegedly defective product. In addition, some recent Supreme Court decisions have driven up costs by shifting spending to the front end of a class action.
"The complexity of a case or a large number of allegations can make it harder to get a case dismissed and cost more money," said Garganta. "The more products and factual allegations, the more potential discovery that is going to happen, which is expensive."
