Managing Intellectual Property Quotes Marjorie Norman on the USPTO’s New Fee Increases

On December 7, 2020, Marjorie Norman was quoted in Managing Intellectual Property on the United States Patent and Trademark Office’s (USPTO) new and increased trademark fees, which will go into effect on January 2, 2021.

According to the article, one of the trademark office’s priorities is to improve the integrity of its register and ensure that applicants don’t seek marks for goods and services that they don’t intend to use – which it can better ensure with extra funding. For these reasons, the office has introduced a new fee for applicants that delete goods or services from a registration after they submit a Section 8 (for registrations not based on the Madrid Protocol) or Section 71 (for Madrid Protocol registrations) declaration of use or excusable non-use, before the declaration is accepted.

Norman says this fee will motivate trademark owners to be extra careful when they check which goods and services are in use.
