The statute’s untested provision barring regulations that are “substantially similar” to disapproved rules may also present political difficulties, observers say.
That language “puts a pretty big limit on the administration to deal with that very same issue,” said Fred Wagner, a partner at the industry law firm Venable, LLP. “There may be any number of places where it isn’t just a matter of taking a regulation off the books, but it’s a matter of the administration wanting to reform the way a certain regulation is implemented affirmatively, and there’s a CRA action and then they can’t do anything, they may not like that.”
