Damon W.D. Wright


Damon Wright represents tech companies, web-based businesses, online advertisers, government contractors, and professionals in intellectual property, advertising, e-commerce, internet law, business tort, contract, and government investigation matters. Following a federal judicial clerkship, he joined Venable in 1997 and has been a Venable partner since 2005. Damon serves clients as a zealous, effective advocate and a prudent, thoughtful counselor.

As a litigator and trial lawyer, Damon successfully represents businesses in courtrooms and forums throughout the country. This includes the "Rocket Docket," the fast-moving U.S. District Court for the Eastern District of Virginia, where he has handled over forty cases and served as President of the Court's Bar Association. Through successful motions, favorable settlement, or wins at trial, Damon has prevailed in high-stakes business litigation, trademark and copyright infringement, patent infringement, false advertising, FTC and State Attorney General investigations, defamation, right of publicity, affiliate marketing fraud, trade secret misappropriation, as well as "bet the company" matters. He understands how to be both thorough and efficient. He enjoys digesting the evidence, identifying the strengths and weaknesses for each side, and then effectively presenting his client’s case.

Outside the courtroom, Damon enjoys helping clients avoid litigation and protect themselves to achieve long-term growth and success. Through his industry knowledge and years of experience problem-solving with clients, Damon understands the business and legal issues that tech, advertiser and web-based clients face and how to best handle those issues in a proactive way. Damon regularly advises and assists clients on a range of issues including regulatory compliance, website disclosures, trademark and copyright protection, patent protection, trade secret protection, contract review and negotiation, acquisitions, media relations, on-line reputation management, and crisis management. Damon is AV® Peer-Review Rated by Martindale-Hubbell.

Significant Matters

Damon's recent matters include:

  • For online people finder and public records company, obtained multiple consent judgments, including substantial damages and permanent injunctions, following trademark and copyright infringement by competitors.
  • At trial, represented newspaper in trademark infringement case and obtained permanent injunction requiring that competing newspaper change its name.
  • For International online dating service business in suit brought by major competitor, succeeded on motion to vacate default and thereafter obtained dismissal with prejudice of competitor’s false advertising, trademark infringement, and unfair completion claims, with court further entering award of attorney's fees and costs.
  • Represented online computer and television retailer in defense of FTC investigation resulting in closed investigation and no enforcement action.
  • For business owner plaintiffs in defamation case against consumer complaint website, defeated motion to dismiss asserting Section 230 immunity under the Communications Decency Act.
  • In evidentiary hearing before BBB, represented online nutraceutical retailer and persuaded BBB to restore client’s BBB accreditation and A+ rating.
  • Won sanctions, summary judgment and affirmance on appeal in false advertising case against online sports memorabilia retailer, with federal court awarding all actual damages, treble damages and attorney's fees.
  • Represented national credit card issuer at trial in contract and unjust enrichment case, with court entering judgment for credit card issuer and requesting that plaintiff's witness be prosecuted for perjury.
  • Represented telecom software company in breach of contract action by reseller with court dismissing all non-contract claims and entering judgment on the contract claim that plaintiff could recover no damages.
  • For national health and beauty retailer, obtained preliminary injunction and then favorable settlement in trademark infringement, trade dress infringement and misappropriation case against competitor.
  • Won sanctions, summary judgment, and affirmance on appeal in trademark infringement, fraud, and breach of duty of loyalty case between competing government contractors.
  • At trial, represented software company founders against publicly-traded corporation in securities fraud, stock conversion and shareholder dispute, with relief including sanctions, compensatory and punitive damages.
  • Represented telecom software company in patent infringement and trade secret misappropriation case against competitor, obtaining evidence that led to grant of pretrial motions and favorable settlement.
  • Represented several high net worth clients in fraud and accounting malpractice suits against national accounting firm, obtaining evidence that led to partial summary judgment, favorable settlements and federal criminal prosecution.
  • On behalf of several web-based business clients over the years, negotiated with national media outlets to retract, narrow or balance otherwise unfavorable media coverage.


Damon is Past-President of the N.Va. Chapter of the Federal Bar Association, comprised of over 230 attorneys who regularly appear before the U.S. District Court for the Eastern District of Virginia. He is a Master with the William B. Bryant Inn of Court, comprised of attorneys who regularly appear before the US. District Court for the District of Columbia. He frequently writes and speaks on litigation and trial advocacy subjects, as well as internet law.

Since 2002, Damon has led a Venable team representing a young man who was wrongly convicted of murder and sentenced to death in Alabama. He also represents Together We Bake – a job-training and personal empowerment program based on a micro-baking business – that helps women recently released from prison. For his public service with the “Robes in the Schools” project, Damon was named a Diversity Champion by Just The Beginning Foundation, a non-profit founded by African-American federal judges dedicated to promoting diversity in the legal profession.

Damon is also an avid music fan. Combining business with pleasure, he leads a group of friends and clients to the SXSW music festival every year and represents the band Rusty Maples as well as Dave Gutter, lead singer of the bands Paranoid Social Club, Rustic Overtones, and Armies. In other spare time, Damon manages the local cover band Noise In The Basement, coaches youth soccer and basketball, and enjoys trying to keep up with his three kids.
