David J. Heubeck

For almost 30 years, Dave Heubeck has concentrated his nationwide litigation practice on the resolution of product liability, intellectual property, and commercial disputes that involve complex issues of science and technology. He has served as national counsel in multiple MDL and state court consolidated mass tort proceedings and tried numerous product, patent, trademark, and commercial litigation matters that resulted in favorable verdicts or settlements on behalf of his clients.

Significant Matters

Since 2009, Dave has served as trial counsel or a member of the trial team in 9 separate multi-week trials in MDL or state court mass tort proceedings on behalf of a pharmaceutical manufacturer. Defense verdicts were obtained in 7 of the 9 cases.

In his role as national counsel, Dave has been responsible for overseeing and managing the collection, review, and production of tens of millions of pages of documents, the preparation of company witnesses for deposition and trial testimony, the selection and preparation of experts, the preparation and submission of dispositive and evidentiary motions, and the presentation of the case at trial.

Dave was part of the trial team that obtained a favorable preemption ruling that resulted in the dismissal of over 650 plaintiffs in a post-Wyeth v. Levine pharmaceutical litigation alleging that the manufacturer had failed to warn of a potential risk.

Dave obtained a $12.4 million willful infringement jury verdict and judgment on behalf of an electric fireplace manufacturer in a two week jury trial in the Northern District of Illinois. The judgment was summarily affirmed by the Federal Circuit the day after oral argument.

Dave obtained a jury verdict and judgment in excess of $10 million plus stipulated attorneys’ fees of $3 million on behalf of an industrial client in a product defect case following a 9 week jury trial in the Eastern District of Ohio.

Dave successfully defeated an effort to bring a class action proceeding in Maryland state court for alleged violations of the Telephone Consumer Protection Act.
