David J. Heubeck


Dave Heubeck is a litigator who resolves product liability, intellectual property, and commercial disputes involving complex issues of science and technology. Dave has served as national counsel in numerous federal multidistrict and state consolidated mass tort proceedings, and has tried numerous product, patent, trademark, and commercial litigation matters that resulted in favorable verdicts or settlements for his clients.

In his role as national counsel, Dave has developed and overseen the execution of litigation strategy, tried cases, prepared company witnesses for deposition and trial testimony, selected and prepared expert witnesses, drafted dispositive and evidentiary motions, and overseen the collection, review, and production of tens of millions of pages of documents.

Significant Matters

  • Since 2009, has served as trial counsel or trial team member in nine separate trials in federal or state court mass tort proceedings, defending the pharmaceutical manufacturer Merck against allegations that its Fosamax product caused jaw problems and unusual leg fractures; helped win defense verdicts in seven of these cases
  • Member of the trial team that obtained a favorable preemption ruling that resulted in the dismissal of more than 650 plaintiffs in post–Wyeth v. Levine pharmaceutical litigation alleging that the manufacturer had failed to warn of a potential risk
  • Obtained a willful infringement jury verdict and a $12.4 million judgment on behalf of an electric fireplace manufacturer in the Northern District of Illinois; judgment was summarily affirmed by the Federal Circuit the day after oral argument
  • Obtained a jury verdict and judgment of more than $10 million, plus stipulated attorneys' fees of $3 million, on behalf of an industrial client in a product defect case, following a nine-week jury trial in the Eastern District of Ohio
  • Defeated an effort to bring a class action proceeding in Maryland state court for alleged violations of the Telephone Consumer Protection Act
