Guido E. Toscano

Associate

Guido Toscano is a litigator in Venable's Los Angeles office. He provides high-end legal representation to clients facing all types of disputes. His practice is focused on trust and estate litigation, especially cases involving breach of fiduciary duty, forgery, lack of capacity and undue influence.

Additionally, Guido has successfully represented clients in entertainment industry cases involving fraud, breach of contract, misappropriation of trade secrets, and non-payment of royalties.

Prior to joining Venable, he also helped clients defend against regulatory investigations involving the FDA and Congress.

Apart from litigation, Guido has counseled clients on compliance with state and federal regulations and advised nationally branded manufacturers and retailers of consumer products (including cosmetics, dietary supplements, and foods) on their responses to pre-litigation demand letters.    

Representative Matters:

  • Represented a trustee/beneficiary in litigation to revoke a trust based on alleged forgery, undue influence and lack of capacity.
  • Represented trustees of $100 million estate against claims of undue influence and incapacity brought by son and grandson of testator. Defeated claims by grandson following bench trial establishing that he lacked standing to proceed.
  • Represented a co-trustee to pursue the removal and disinheritance of a co-trustee/beneficiary based on a no-contest provision.
  • Represented a hospitality company in litigation involving investors who alleged breach of contract, conversion, and breach of fiduciary duty in connection with the development of a luxury hotel.
  • Represented a cosmetic company in litigation against a national pharmacy retailer to stop trademark infringement, unfair competition, and the unauthorized sale of defaced cosmetic products.
  • Represented an infomercial production company in litigation involving non-payment of royalties for sales of a popular blender product.
  • Represented a company in discovery disputes with CBS's 60 Minutes regarding the confidentiality of company documents.
  • Represented a pharmaceutical company in connection with a regulatory investigation by the FDA and the U.S. House Committee on Energy and Commerce regarding contaminated heparin.
  • Represented a supplement drink company in federal class action litigation challenging product advertising claims for glucosamine and chondroitin sulfate.
  • Advised a national vitamin retailer and a deep discount retailer on price advertising on compliance with FTC guidance and state consumer protection laws.
