Every year for the past five years, the number of convictions for violating the federal Foreign Corrupt Practices Act has doubled from the year before. The last two years have seen the first cases involving charitable activities outside of the United States. The U.S. Justice Department's focus on this area continues to increase. This Legal Quick Hit will provide a brief update on the status of FCPA enforcement, practical tips to minimize liability risk, and an overview of the three other major U.S. enforcement initiatives where the nonprofit community is at risk: reporting foreign bank accounts, failing to conduct due diligence on foreign counterparties, and accepting funding from foreign sources.
