Replacing New York’s Lieutenant Governor: Revisiting Skelos v. Paterson

Venable attorney Peter J. Kiernan will present on a New York State Bar Association panel discussing "Replacing New York’s Lieutenant Governor: Revisiting Skelos v. Paterson" on April 28, 2022.

The panel will examine the legal implications of selecting a new lieutenant governor following the indictment and resignation of New York Lt. Gov. Brian Benjamin in light of the 2009 Skelos v. Paterson case, which raised the issue of whether a governor has the authority to appoint a lieutenant governor in the state of New York.

The panelists will include:

  • Peter J. Kiernan, senior counsel at Venable, who was Gov. Paterson’s counsel in 2009
  • John Ciampoli, of counsel to Messina Perillo Hill, who was counsel to the Senate Republicans in 2009
  • Professor Michael Hutter, Albany Law School, who submitted an amicus brief opposed to the Ravitch appointment
  • Professor Richard Briffault of Columbia Law School who wrote an amicus brief for Citizens Union of New York City in support of the Ravitch appointment
