Their article considers the implications of the ruling of the Ninth Circuit Court of Appeals Rentmeester v Nike Inc No. 15-35509 (9th Cir. 2018) and discusses the broader implications for copyright owners following the District Court's dismissal of an action brought by a photographer against Nike. The dismissal was on grounds that Nike infringed the photographer’s copyright in a photograph of Michael Jordan when it commissioned its own photograph of Jordan and then used that photo to create its "Jumpman" logo.
