In a comprehensive panel discussion moderated by Venable partner Ari Markenson, leading professionals explored the potential trajectory of healthcare policy under the second Trump administration. Panelists identified key priorities such as Medicare reform, Medicaid adjustments, and regulatory shifts at the FDA. Discussions emphasized the complexities of implementing significant healthcare changes within a divided government and a constrained administrative framework.

One highlight of the discussion was the potential impact of Mehmet Oz's appointment to lead the Centers for Medicare and Medicaid Services (CMS). Senior policy advisor Ilisa Halpern Paul noted the significance of having a practicing physician in this role for the first time in years, with Oz advocating for policies like "Medicare Advantage for all" and enhanced telehealth services. However, Paul cautioned that major overhauls, such as site-neutral payment policies, might face hurdles in Congress despite their potential cost savings. Similarly, the panel acknowledged the enduring challenges of addressing prescription drug pricing, an area of bipartisan interest, but one fraught with legislative and legal obstacles.

Regulatory shifts under the Trump administration were another focal point. Partner Jeremiah Kelly highlighted the anticipated leadership changes at the FDA, including the appointment of Dr. Martin Makary as commissioner of food and drugs. Makary's expertise as a surgeon and public health advocate could shape priorities around drug affordability and supply chain transparency. However, Kelly reassured stakeholders that the FDA's regulatory frameworks provide stability, even amid leadership transitions. Partner Valerie Cohen further underscored the likelihood of continued robust enforcement efforts, including those made under the False Claims Act, with changes likely influenced more by leadership priorities than by partisan shifts.

The panel provided a balanced view of the opportunities and constraints shaping the future of federal healthcare policy. While the administration may pursue ambitious reforms, they said, the path forward is shaped by regulatory processes, bipartisan tensions, and public scrutiny.
