Jessica Lubar and Jeffrey Tenenbaum are presenting a Legal Quick Hit to the Association of Corporate Counsel's Nonprofit Organizations Committee entitled, "Nonprofits as Employers: The IRS Is Looking at You."
Over the last several years, the IRS has launched several initiatives focused on compliance issues or perceived compliance issues with tax-exempt organizations. Compensation and employment taxes have been a part of most of these projects. The IRS has been using the information that it has gathered to help focus its audit techniques. Additionally, the IRS recently acknowledged an employment tax audit program that will be commencing in the Fall and continue for three years. It is expected that the project could result in 2,000 tax examinations during each of the three years. Therefore, it is critical that nonprofit employers understand the issues that arise in the employment tax arena. During this Legal Quick Hit, you will learn about how to classify your workers for tax purposes as either independent contractors or employees, and whether fringe benefits that you provide are taxable or tax-free to the recipient.
