The article discussed the U.S. Supreme Court's ruling in Sorrell v. IMS America striking down a Vermont law that banned on First Amendment grounds commercial marketing uses of prescription data stripped of patient identifiers. Cividanes noted that, "Despite urging by the state of Vermont, 35 state Attorneys General, the US Department of Justice, privacy advocates and others to uphold Vermont's efforts to restrict data mining of physician prescriber records for drug marketing purposes, the Supreme Court struck down Vermont's Prescription Confidentiality Act because it was an anti-marketing law masquerading as a privacy law. The ruling in Sorrell will have major implications for existing and proposed privacy laws."
