Venable partner Paul Strain was quoted in an October 18, 2010 Health & Medicine Week article about Merck & Co.’s decision to appeal a ruling in favor of a Florida woman who claimed that her dental and jaw problems were a result of using FOSAMAX.

During the trial, Merck presented evidence showing that the plaintiff suffered from other medical problems that could cause jaw problems, regardless of whether or not she used FOSAMAX.

"We disagree with the jury's verdict and will vigorously defend against plaintiff's claims on appeal. We believe the verdict was contrary to the evidence presented at trial and influenced by plaintiff's counsel's inflammatory and prejudicial remarks," said Strain. "The plaintiff was at increased risk for dental and jaw problems regardless of her FOSAMAX use."
