Megan Mann is counsel in Venable's Labor and Employment and Education practices, where she works collaboratively with her clients, actively joining their teams to ensure she is intimately familiar with each organization's operations, mission, and environment. This cooperative approach allows her to engage in practical problem-solving and provide useful legal guidance.

Megan has particularly extensive experience representing clients in the education industry, including independent and charter schools (pre-K through 12th grade), higher education institutions, early childhood education centers, music conservatories, and athletic organizations. Megan works collaboratively with her clients, actively joining their teams to ensure she is intimately familiar with each organization's operations, mission, and environment. This cooperative approach allows her to engage in practical problem-solving and provide useful legal guidance.

Counseling

Megan offers practical ways to address routine and complex issues facing both employers and educators. She regularly works with clients to ensure compliance with relevant laws, including but not limited to laws governing family and medical leaves of absence, disability accommodations, human rights in employment and education, and wage and hour issues for employers. She also helps clients improve the quality and efficacy of various employment- and education-related practices, policies, and documents. This type of counseling includes:

  • Rendering advice related to workplace practices, including employee classification, wage and hour practices, and disability accommodations
  • Advising education institutions on practices related to students, including discipline and removal, and advising on issues involving disputes among parents or other members of the community
  • Advising clients on federal, state, and local leave laws, and providing guidance on how to practically and legally manage the application of same
  • Drafting new or updating existing documents, such as employee handbooks, offer and termination letters, severance agreements, performance management (including discipline) documents, student and parent handbooks, travel and activity documents, Title IX policies, and other related school documents
  • Rendering advice related to the entire life cycle of employment, from hiring to termination processes, including group layoffs, and performance management during an employee's tenure, to ensure compliance with applicable laws and to appropriately protect clients' interests
  • Similarly, Megan counsels educational organizations on matters that affect the student's life cycle at the school, including accommodations, discipline, and removal
  • Conducting, advising on, and overseeing investigations for educational organizations and employers involving allegations of misconduct between adults and minors

Training

Megan has significant experience conducting a vast array of group and individual on-to-one training sessions for both employers and educators. While Megan works with her clients to customize each training to their organization's specific needs, below is a list of typical topics that the trainings can cover:

  • Harassment awareness and prevention (including training sessions that are compliant with evolving local laws)
  • Professional, safe, and appropriate boundaries with students and other members of the school community
  • Mandatory reporting obligations
  • Recognizing signs of abuse, neglect, maltreatment, child grooming, and bullying
  • Conducting an effective workplace investigation
  • Navigating simple to complex issues related to leaves of absence, FMLA application, and requests for disability-related accommodations
  • Leadership (including mindful leadership)
  • Team reinforcement and building
  • Performance management, including discipline
  • Documentation practices
  • Creating and maintaining safe spaces in the workplace or classroom
  • Consent (in the context of student sexual activity)

Dispute Resolution

Megan is also experienced in employment- and education-related litigation, and alternative dispute resolution, whether in mediation or arbitration.

Investigations  

Megan collaborates with employers to conduct workplace investigations and advises clients on their own internal investigation procedures.
