Katelyn J. Patton


Kate Patton represents clients in a broad range of industries in advertising, marketing, intellectual property, antitrust, and regulatory matters. Kate’s practice includes private and government litigation, federal and state government investigations, and client counseling. She regularly represents companies in investigations and litigation with the Federal Trade Commission (FTC), Department of Justice (DOJ) and state attorneys general, and in litigation involving consumer protection issues.

Prior to joining Venable, Kate practiced in the litigation department of a New York law firm, with an active trial practice in state and federal courts. She represented clients in commercial business disputes and employment matters, and before the National Advertising Division of the Council of Better Business Bureaus (NAD) and the Trademark Trial and Appeal Board (TTAB). Kate also has a background in marketing communications and government affairs.


Representative Matters

  • Represented a global fitness and wellness aggregator in a proposed $1 billion acquisition by a leading technology provider to the fitness, wellness, and beauty industries in a DOJ Second Request investigation, which DOJ ultimately closed without further action
  • Representing a corporate defendant in a class action in California federal court alleging that unsolicited text messages promoting a political campaign violate the Telephone Consumer Protection Act
  • Conducted a comprehensive review of a medical supply distributor’s website and advertising claims, and counseled on compliance risks under federal and state unfair and deceptive trade practices laws as well as price gouging regulations in the context of increasing regulatory scrutiny during the COVID-19 pandemic
  • Representing an independent contractor in an FTC investigation into whether business development practices amount to credit card laundering or assisting or facilitating violations of the Telemarketing Sales Rule
