In a July 2020 decision, the EU Court of Justice dealt a blow to international data transfers that invalidated the US Privacy Shield program. The decision also placed upon European data exporters an obligation to ensure adequacy when transferring data under other permissible methods. Our panel will discuss the current state of recommendations and guidance, in the wake of the 2020 decision, the effects of the European Data Protection Board’s comments, and the revised standard clauses on cross-border transfers.
