The days when nonprofit organizations could simply mail out pledge cards and await a response to generate necessary fundraising revenue are gone.  But in these difficult economic times, even the smallest nonprofit can learn how to tap into the power of promotional and marketing campaigns and capitalize on new media and technologies to raise funds and awareness for their causes.  These activities may, however, trigger unanticipated responsibilities for the nonprofit on both the state and federal regulatory fronts.  In this program, you will hear from two Venable attorneys well-versed in the related areas of promotions and charitable fundraising, who will help explain the myriad of legal and regulatory issues involved in promotional and fundraising campaigns, as well as the latest developments in the area.

Specific topics to be covered will include:

  • State and federal requirements and restrictions for raffles, sweepstakes and contests;
  • Considerations for fundraising via social media and mobile giving platforms;
  • Overview of state registration and reporting responsibilities involved in charitable solicitation for charities, professional solicitors, and commercial co-venturers, including updates in enforcement actions in this area; and
  • Federal tax and tax-exemption implications for sweepstakes, sponsorships and other promotions.
