This presentation will address the legal arguments before the U.S. Supreme Court after the Court's historic ruling addressing the definition of "discharge" under the Clean Water Act. The panel will summarize the legal arguments before the Court and discuss the new test established by the Court identifying what constitutes a "functional equivalent" and a discharge's "specific identity" when considering discharges from point sources.
