On Thursday, April 11, Danielle Foley will co-present “Third-Party Subpoena Recipients: Enemies or Friends?” at the 72nd Antitrust Law Spring Meeting at the Marriott Marquis in Washington, DC. In this session, the panelists will consider the ethics of this hypothetical: a litigant subpoenas a third party; the adversary, via back channels, discourages the third party from cooperating. The audience will be polled for reactions to this and similar scenarios, before putting the question to ethics experts and practitioners on the panel.
