Jean-Paul Cart represents clients in complex business litigation matters in all varieties of business torts and commercial disputes, including consumer class actions, trademark infringement, securities and derivative class actions, licensing and contract actions, insurance disputes, privacy litigation, ADA website accessibility and Proposition 65 claims, and other related commercial litigation. Jean-Paul also provides pre-litigation risk analysis and counseling to clients involved in complicated transactions. His experience also covers all aspects of litigation, from declaratory relief actions to nine-figure demands.

Representative Matters

  • Defeated class certification on behalf of product manufacturer facing putative class action “slack fill” claims under California’s Consumers Legal Remedies Act (CLRA) and Unfair Competition Law (UCL)
  • Obtained various dismissals for a hospitality company in putative class actions under California’s CLRA, UCL, and Rosenthal Fair Debt Collection Practices Act (RFDCPA), and the Telephone Consumer Protection Act (TCPA)
  • Defeated class certification in putative insurance class action brought by third-party claimant alleging unfair claims handling practices
  • Obtained dismissal of putative employee benefits class action on behalf of a public university
  • Obtained favorable class action settlement in case alleging noncompliance with the Fair and Accurate Credit Transactions Act (FACTA).
  • Successful prosecution of claims for the unauthorized use of Muhammad Ali’s identity in a promotional video broadcast during the pregame show before the Super Bowl
  • Successfully tried breach of fiduciary duty and negligence claims on behalf of the FDIC, in its receivership capacity following a bank failure
  • Defeated fraudulent attempt to establish first use of a trademark sought by celebrity client
  • Represented leading apparel manufacturer in several trademark infringement cases, on both the plaintiff and defense sides
  • Represented various companies in connection with distributorship disputes, trademark licensing, and royalty disputes
  • Successfully defended client following collapse of significant real estate transaction, resulting in complete defense victory and significant monetary payment from opposing counsel’s malpractice insurance carrier
  • Represented real estate developers in connection with partnership and employment disputes
  • Represented a drug manufacturer in several federal securities class actions regarding product recalls, including on appeal to the U.S. Supreme Court, and shareholder derivative class actions relating to a successful tender offer in a going-private transaction
  • Advised various clients regarding cybersecurity and privacy legal compliance and risk mitigation strategies
  • Represented and counseled numerous companies regarding actual or potential claims under the Americans with Disabilities Act (ADA) and Unruh Civil Rights Act relating to website accessibility, compatibility with screen readers used by the visually impaired, and implementation of the Web Content Accessibility Guidelines (WCAG)
  • Represented and counseled product manufacturers regarding actual or potential claims under California’s Safe Drinking Water and Toxic Enforcement Act of 1986 – otherwise known as Proposition 65
