Kathryn Lundy is a seasoned litigator and management-side labor and employment lawyer who handles the full spectrum of employment-related matters. Kathryn is regularly called upon to handle high-stakes litigation disputes, including sexual harassment and discrimination, wrongful termination, wage and hour violations, misappropriation of trade secrets, and breach of contract. Clients also seek Kathryn’s advice and counsel regarding the gamut of complex employment issues, including restrictive covenants, investigations, audits, executive compensation, wage and hour compliance, reductions in force, policy development, and the negotiation of complex employment and separation agreements.

In addition, Kathryn counsels and litigates a broad array of matters to secure emergent relief to enforce restrictive covenants and protect client rights under the Defend Trade Secrets Act (DTSA) and related state laws. She maintains an active practice in counseling organizations prior to anticipated litigation in either prosecuting or defending against claims of misappropriation of trade secrets, tortious interference with a contract (i.e., restrictive covenant), and prospective business relationships.

Kathryn represents an array of clients, primarily in the hospitality, consumer products, and luxury retail industries.

Representative Matters

  • Attained a summary judgment dismissal of a lawsuit pending in the Southern District of New York for a sexual harassment and discrimination allegation on behalf of a world-renowned restaurant
  • Represented and defended an international hospitality group in contract disputes arising from suspension of operations during COVID-19
  • Served as lead trial counsel for a national consumer products manufacturer against a claim for breach of contract and fraudulent inducement by a former chief executive officer through a directed verdict
  • Defeated an appeal to the New York Court of Appeals affirming the lower court’s order granting the client’s summary judgment motion for breach of contract
  • Enforced restrictive covenants against a group of former employees by obtaining a temporary restraining order and preliminary injunction in New York County Supreme Court
  • Defended against a wage and hour class action in the Eastern District of New York and limited the putative class of 100 individuals to only a subset of 25 employees, resulting in a favorable settlement
  • Obtained a temporary restraining order on behalf of a major luxury apparel company for misappropriation of confidential and trade secret information
  • Advised and represented an employer during a union organization campaign with IUOE Local 150
  • Handled unfair labor practice charges against clients by 32BJ
  • Conducted an independent investigation of a highly sensitive internal complaint of sexual harassment at a national real estate firm
  • Obtained a temporary restraining order in a “bet the farm” litigation for breach of fiduciary duties, misappropriation of trade secrets, and tortious interference with contracts
