Venable partner Caryn Pass was quoted in the January/February 2016 issue of Net Assets magazine on how independent schools should handle faculty and staff departures. Whether an employee leaves voluntarily or if their employment is terminated, the school must deal with a range of issues from complying with the law to ensuring continuity.
"If you walk them out the door in the middle of the day so everyone can see them, that's not very nice and that's when people are more inclined to sue," said Pass. She also noted that in cases of egregious conduct, a severance payment may not be justified.
