A complex web of federal environmental laws and regulations govern transportation projects of all sizes and scopes. Often, compliance with those laws is costly, time-consuming, and subject to legal challenges that can grind projects to a halt. But sometimes savvy developers can streamline the regulatory process by invoking certain administrative programs and legal doctrines that allow agencies and private parties to fast track environmental review.
This presentation explores several methods ARTBA members and their regulating agencies can use to simplify environmental compliance and litigation under three federal environmental laws that routinely impact transportation and infrastructure projects: the National Environmental Policy Act (NEPA), the Endangered Species Act (ESA), and the Clean Water Act (CWA). Kyle Robisch of Venable LLP briefly introduces attendees to each statute and its common applications to transportation projects, describes the several fast-tracking strategies available under each statute, and explains how companies and their counsel can best utilize those strategies where possible. At the end of the 45-50 minute presentation, Kyle will take questions.
