Griesedieck explained that while the regulations “do provide contractors an opportunity to respond to FASC recommendations for removal or exclusion,” the new procedures are untested at this stage. “It is not yet clear whether sources recommended for exclusion or removal will receive adequate due process protections when contesting FASC’s determinations,” he said.

Griesedieck believes that there is “broad agreement among federal policymakers and regulated entities that the security of the government’s supply chains is important.” With this in mind, he added that “the specifics surrounding how to achieve supply chain security for the government, and who bears which risks and costs, are in many ways still unresolved.”
