Trade Law Daily Quotes Liz Lowe on the End of IEEPA Tariffs Following Supreme Court Ruling

On February 20, Trade Law Daily quoted Liz Lowe on the Supreme Court’s decision that the International Emergency Economic Powers Act (IEEPA)  doesn't provide any tariff authority to the president.

According to the article, President Trump ordered an end to all tariffs imposed under IEEPA after the Supreme Court ruled that the statute does not grant the president tariff authority. The president also simultaneously imposed a 10% across-the-board tariff under Section 122 maintaining the suspension of de minimis treatment.

The executive orders were issued amid uncertainty over how relief would be implemented after the Supreme Court determined that all IEEPA tariffs were unlawful.

Commenting on the developments, Lowe explained that the president’s directive to halt IEEPA tariff collection moots the concern over how long the tariffs would continue to be collected.
