Megan Barbero of Venable LLP, a former SEC general counsel, told Law360 on Monday that Geyser's arguments that the SEC's reading of the case would trigger jury trial rights by turning disgorgement into a penalty seemed to gain traction with at least some of the justices.
"Although [Stewart] distinguished Jarkesy as a civil penalty case arising in an administrative proceeding, that answer did not seem to eliminate the court's concern about the jury trial implications of the SEC's position," said Barbero.
