USA Today Quotes Larry Mandelker on Malcolm-Jamal Warner's Estate Dispute

1 min

On July 25, Larry Mandelker was quoted in USA Today on the legal dispute involving Malcolm-Jamal Warner's widow and the late actor's family trust.

According to the article, Malcolm-Jamal Warner's mother is being sued by his widow, who alleges she is owed more than $1.2 million under a premarital agreement. The dispute centers on the revocable Warner Family Trust, which allegedly left nothing to Warner's widow because it was established in 1996 and was not updated to reflect his marriage and new family.

Commenting on whether a trust could be used to satisfy the widow's claim, Mandelker explained that because the trust is revocable, it remains under the grantor's control during life and is therefore generally subject to creditor claims.

"The trust is revocable. It was under his control during life, so it's subject to creditor claims. She has a valid contractual claim, the same as if he owed the IRS money or credit card money."
