Petitions for Inter Partes Review by Cardiovascular Systems

On December 7, 2018, Cardiovascular Systems, Inc. (“Petitioners”) filed three Petitions to the USPTO’s Patent Trial and Appeal Board (“Board”).

In IPR2019-00405, the Petitioner challenged claims 1-17 of U.S. Patent No. 8,956,371 (“the ‘371 Patent”) as obvious under 35 U.S.C. § 103. The ‘371 Patent is owned by Shockwave Medical, Inc. (“Patent Owner”) and is drawn to a shockwave balloon catheter system.

In IPR2019-00408, the Petitioner challenged claims 1-20 of U.S. Patent No. 9,642,673 (“the ‘673 Patent”) as obvious under 35 U.S.C. § 103. The ‘673 Patent is owned by the Patent Owner and is drawn to an angioplasty shockwave balloon catheter with multiple shockwave sources.

In IPR2019-00409, the Petitioner challenged claims 1-14 of U.S. Patent No. 8,728,091 (“the ‘091 Patent”) as obvious under 35 U.S.C. § 103. The ‘091 Patent is owned by the Patent Owner and is drawn to a shockwave balloon catheter system with energy control.

The inter partes reviews remain pending at the Board.
