On February 29, 2012, Becky Pearson and James Boland will discuss recent developments and trends in the Government’s acquisition of commercial products and services at the ABA’s Commercial Products and Services Committee meeting. The discussion will focus on two recent U.S. Court of Federal Claims bid protests in which Venable successfully challenged the Government’s attempt to use certain non-commercial terms and conditions to acquire commercial services as violations of FAR Part 12. The cases are U.S. Foodservice v. United States, 100 Fed. Cl. 659 (2011) (C. Miller), and CW Government Travel v. United States, 99 Fed. Cl. 666 (2011) (G. Miller).
