Paul Debolt will speak on a panel addressing fraud counterclaims, i.e., counterclaims arising under the False Claims Act (31 U.S.C. § 3729), the Contract Disputes Act’s fraud provisions (41 U.S.C. § 7103), the Forfeiture of Fraudulent Claims (28 U.S.C. § 2514) and common law fraud.

The panel will discuss current trends related to fraud counterclaims before the U.S. Court of Federal Claims and the impact of fraud counterclaims on a variety of topics including litigation tactics and scheduling, the scope of discovery, settlement negotiations, forum selection (i.e., the Boards of Contract Appeals versus the U.S. Court of Federal Claims) and the decision whether or not to appeal the denial of a certified claim.
