Session Title: COMPLYING WITH THE AFFORDABLE CARE ACT: “Obamacare” Requirements that Restaurant and Foodservice Employers Can’t Afford to Miss

Description:  Now that the government’s website is up and running, more employees are seeking health insurance pursuant to the Affordable Care Act.  Under the law, many restaurant and foodservice employers must notify their employees of the availability of state insurance exchanges, eligibility criteria, and information about employer contributions, among other things.  Employers in the restaurant and foodservice industry should evaluate whether they are in compliance with the Affordable Care Act, and many covered employers must choose between paying for their employees’ health insurance coverage, or alternatively, paying a tax penalty.  For some employers, paying the tax penalty in lieu of providing insurance benefits may result in substantial savings.

We will answer common questions from restaurant and foodservice employers about the Affordable Care Act, including:

  • Does the Affordable Care Act apply to your business?
  • Is your business better off paying the tax penalty instead of providing insurance benefits?
  • Has your business complied with the Affordable Care Act’s requirements thus far?
  • What are the upcoming deadlines for your business and your employees who want coverage?
  • Why are your work shift schedules important for compliance?
  • What are your mandatory reporting obligations at the end of the year?
