Many sponsors of retirement plans are facing new issues from: the Internal Revenue Service (IRS) and the Department of Labor (DOL). These agencies are auditing more plans more closely than ever before. The DOL has been aggressive in examining all aspects of plan governance, including how plan committees make decisions, how investment policies are implemented by plan fiduciaries, and the amount of training provided to plan fiduciaries. Both the IRS and DOL have increased the number of health and welfare plan audits. Plan participants have also jumped in, with an increasing number of lawsuits challenging benefits communications, the investment choices provided to them in their 401(k) plans, and denials of claims for plan benefits. This panel will discuss how plan sponsors can reduce their liability from the government agencies and plan participant threats.
