Venable partner Doug Green will participate in a webinar, "Implications of the SCOTUS CWA Ruling on Coal Ash Disposal Facilities," hosted by Gradient, on June 4, 2020. This webinar will address the implications of the recent Supreme Court decision in County of Maui v. Hawaii Wildlife Fund holding that Clean Water Act permits can apply to contamination from a point source that travels through groundwater if "the addition of the pollutants through groundwater is the functional equivalent of a direct discharge from the point source into navigable waters." The panel will provide key takeaways on this ruling as it relates to coal ash disposal facilities and will examine its impact on current and future CWA cases and possible future guidance from the US EPA.
