Surveys provide courts with key insights into many different types of legal claims and defenses related to trademark infringement. They can be regularly used in different stages of a case, from as early as preliminary injunction to a motion for summary judgment, and during trial. With more smartphone users, COVID-19’s impact, and multilingualism, there are many potential complications to be aware of when using surveys in IP litigation. On April 27 from 12 pm to 1 pm ET, Roger A. Colaizzi will present a CLE accredited program, “Emerging Issues Related to the Use of Surveys in IP Litigation,” at the DC Bar Association. This program will examine general issues in relation to both trademark and deceptive advertising surveys.
