On May 2, 2024, Sarah Kahl will present “Trust Decanting in Maryland” at the Anne Arundel Estate Planning Council. This event will take place at the Annapolis Waterfront Hotel in Annapolis, Maryland and will address three practical issues raised by the new law:
Part 1: Key Provisions of Maryland’s New Trust Decanting Act: Participants will gain understanding of when the statute allows a trustee to modify a trust through decanting and which terms may or may not be changed.
Part 2: Tax Considerations: This segment will focus on the income, gift, and generation-skipping transfer tax consequences that trustees should consider before decanting.
Part 3: Decanting in Practice: Participants will delve into practical aspects of decanting, such as whether to retitle assets, which documents to prepare, and whether to obtain a new EIN. Common fact patterns will be explored through examples.
